Terms and Conditions

Please read these terms carefully before using MedKeep. By downloading or using the App, you agree to be bound by them.

The short version:Use MedKeep to organise your family's health records. Don't misuse it. It's not a medical device and doesn't provide medical advice. Your data is yours, always.

1. Acceptance of Terms

These Terms and Conditions ("Terms") are a legal agreement between you ("User," "you," or "your") and MedKeep ("we," "us," or "our") governing your use of the MedKeep mobile application for iOS and Android (the "App") and any related services.

By downloading, installing, or using the App, you confirm that you have read and understood these Terms and that you agree to be bound by them. If you do not agree, do not use the App.

If you are using the App on behalf of a family unit, you represent that you have the authority to agree to these Terms on behalf of that group and that all family members whose data you add are aware their records are being stored in the App.

2. Description of Service

MedKeep is a private health records organiser that allows you to:

  • Create profiles for your family members
  • Track medications, dosages, and schedules
  • Log vital signs including blood pressure, heart rate, glucose, SpO2, temperature, weight, and respiratory rate
  • Record doctor visits, including visit type, clinic, physician, diagnosis, and treatment notes
  • Store photos and PDFs of lab reports, prescriptions, vaccination records, and other health documents
  • Generate and export health summary PDFs for any family member
  • Set local reminders for medications and follow-up appointments

All data is encrypted on your device using AES-256 encryption. MedKeep operates on an offline-first basis, core functionality is available without an internet connection.

We reserve the right to modify, suspend, or discontinue any part of the App at any time with reasonable notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the service.

3. Not Medical Advice, Important

MedKeep is a personal organisation tool, not a medical device. It does not provide medical advice, clinical diagnoses, or treatment recommendations. Nothing in the App should be construed as medical advice.

The vitals status indicators in the App (such as "Normal," "Elevated," "Low," or "High") are based on general reference ranges from publicly available clinical guidelines. They are provided for organisational and informational purposes only and are not tailored to your individual medical history, condition, or circumstances.

Always consult a qualified, licensed healthcare professional regarding any symptoms, medical conditions, medications, or health decisions. Do not delay seeking professional medical advice based on information displayed in MedKeep. In a medical emergency, call your local emergency services immediately.

MedKeep is not a substitute for professional medical judgement. We are not liable for any health decisions made in reliance on information displayed in the App.

4. Your Account and Vault Security

You are solely responsible for:

  • All activity that occurs within your vault
  • Ensuring that unauthorised individuals do not gain access to your device or vault
  • Maintaining a backup of your data (we recommend enabling optional encrypted cloud backup)

You agree to notify us immediately at hello@medkeep.app if you suspect any unauthorised access to your device or vault.

5. Subscriptions and Billing

Free trial

MedKeep offers a 7-day free trial with full access to every feature. A valid payment method is required to start the trial via the App Store or Google Play. You will not be charged until the trial period ends. You can cancel at any time before the trial ends through your App Store or Google Play subscription settings to avoid being charged.

Family plan

After the free trial, MedKeep is available on a Weekly ($2.49/week) or Yearly ($19.99/year) subscription. Both plans include identical features, unlimited family member profiles, full record tracking, encrypted cloud backup, PDF export, and priority support. Pricing is displayed in the App and in the relevant App Store listing.

Billing

All subscriptions are processed and managed through the Apple App Store or Google Play Store as in-app purchases, subject to their respective terms of service. Subscription fees are charged to your account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period.

To cancel, manage your subscription through your App Store or Google Play account settings. Refunds are subject to the refund policies of Apple or Google. We do not issue refunds directly.

6. Acceptable Use

You agree to use MedKeep only for its intended purpose, organising personal health records for yourself and family members you have authorisation to manage. You agree not to:

  • Use the App for any unlawful purpose or in violation of any applicable laws or regulations
  • Store records for individuals who have not consented to having their health information stored in the App
  • Attempt to reverse-engineer, decompile, or disassemble the App
  • Use the App to store, transmit, or share content that is illegal, harmful, abusive, or fraudulent
  • Attempt to gain unauthorised access to any part of the App's infrastructure or another user's data
  • Interfere with or disrupt the integrity or performance of the App or its underlying services
  • Use the App in any way that could damage, disable, or impair our services

Violation of these terms may result in immediate termination of your access to the App.

7. Intellectual Property

The App, including its design, code, features, branding, logo, and all content created by MedKeep, is owned by MedKeep and protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App for personal, non-commercial purposes in accordance with these Terms.

Your data is yours. You retain full ownership of all health records, documents, and content you create or upload in the App. By using the App, you grant us no rights to your health data beyond what is necessary to provide the service (i.e., storing your encrypted ciphertext).

You may not copy, reproduce, distribute, or create derivative works based on any part of the App without our prior written consent.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the App will be uninterrupted, error-free, or free of viruses or harmful components
  • Warranties regarding the accuracy, reliability, or completeness of any vitals reference ranges or health information displayed in the App

We do not warrant that the App will meet your specific requirements or that any errors in the App will be corrected. Your use of the App is at your sole risk.

9. Limitation of Liability

To the maximum extent permitted by applicable law, MedKeep and its officers, directors, employees, agents, and licensors shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, health records, or goodwill
  • Any health decisions made in reliance on information displayed in the App
  • Any unauthorised access to or alteration of your data resulting from circumstances outside our reasonable control
  • Any loss of data resulting from device loss, failure, or user error

Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, the above limitations apply to the fullest extent permitted by law.

10. Indemnification

You agree to indemnify, defend, and hold harmless MedKeep and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the App in violation of these Terms
  • Your violation of any applicable law or regulation
  • Any content you store, upload, or transmit through the App
  • Your infringement of any third-party rights

11. Termination

You may stop using the App and delete it from your device at any time. Deleting the App removes all locally stored data permanently.

We may suspend or terminate your access to any server-based features (such as optional cloud backup) if you breach these Terms, with or without prior notice depending on the severity of the breach. In cases of suspected fraud or illegal activity, we may terminate access immediately.

Upon termination of any subscription, you retain access to your locally stored data. You can export a PDF summary of your records at any time before or after termination.

Sections 7 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), and 10 (Indemnification) survive termination of these Terms.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

Any dispute arising out of or in connection with these Terms that cannot be resolved amicably shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the European Union, you may also have access to alternative dispute resolution mechanisms provided by your local consumer protection authority.

13. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, legal requirements, or other reasons. When we make material changes, we will notify you through a prominent in-app notice at least 14 days before the changes take effect.

Your continued use of the App after updated Terms take effect constitutes your acceptance. If you do not agree to the revised Terms, you should stop using the App before they take effect.
